• You are strictly prohibited from using ActX to engage in, promote, or facilitate any illegal activities. This includes, but is not limited to, illegal drug transactions, trafficking, and any forms of financial fraud.

• Unless specifically authorized by applicable laws and regulations, using the app for gambling, betting, or any related activities is strictly forbidden.

Malicious Software and Cyber Threats:

• Do not spread, create, or upload any software that can potentially harm the system, other users, or compromise the service, such as viruses, worms, Trojan horses, or any other malicious code.

• Engaging in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the app or any associated services and networks is prohibited.

• Attempting to gain unauthorized access to any part of ActX, its related systems, or networks connected to the app, whether through hacking, password mining, or any other means, is strictly prohibited.

• You may not test, scan, or probe the vulnerability of the app or any associated system or network, nor breach or attempt to breach the security or authentication measures without proper authorization.

• Intercepting or attempting to intercept data not intended for you is forbidden.

Interference with Services:

• Activities that interfere with or disrupt the service provided by ActX or the servers and networks which host our services are prohibited. This includes denial-of-service (DoS) attacks or any other intentional disruptions.

• Exploiting app resources beyond what is provided for normal operational purposes, such as automated data scraping or excessive requests to the servers, is not allowed.

Manipulation and Fraud:

• Impersonating another user, person, or entity, or falsely claiming an affiliation with any person or entity, is prohibited.

• Engaging in practices meant to deceive, mislead, or trick others, such as phishing, "pharming", "spoofing", or manipulating identifiers in order to disguise the origin of any content transmitted through ActX, is forbidden

Enforcement and Consequences:

• ActX reserves the right to monitor all activities on its platform to ensure compliance with these terms. Any violation of these prohibited activities may result in immediate suspension or termination of your account and may subject you to civil liability or criminal prosecution.

• Users are encouraged to report any suspicious or unauthorized activities to ActX immediately to help maintain the security and integrity of the app.

Content Ownership and Licensing

• You are solely responsible for ensuring that you possess the necessary rights to the content you upload and that it does not infringe on the rights of any third party.

Grant of License to ActX:

• By posting content to ActX, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the service provided by ActX and its affiliates. This includes promoting and redistributing part or all of the service (and derivative works thereof) in any media formats and through any media channels.

• This license allows ActX to make your content available to the rest of the world and to let others do the same. However, ActX will only use your content in ways necessary to provide and improve our services, to promote new services, or in other ways you explicitly authorize.

Intellectual Property Rights:

• ActX respects the intellectual property rights of others and expects you to do the same. You must not upload, download, display, perform, transmit, or distribute any content that infringes upon the intellectual property rights of others.

• If you believe that your copyright or intellectual property rights have been infringed by another user on ActX, please inform us following our infringement claim process, which is outlined in our Terms of Service.

• All rights, title, and interest in and to the ActX software, including any updates, enhancements, and new features are owned by ActX or its licensors. Except for the limited license granted to you, no transfer of intellectual property rights is made under this Agreement.

• By sharing your content through ActX, you allow other users to access, display, view, store, and reproduce such content for personal use.

• The above licenses granted by you in your user content terminate when you remove or delete your content from ActX. However, you acknowledge that the license may continue perpetually if your content has been shared with others and they have not deleted it or it was used as part of an aggregate data set that is irrevocable due to its nature.

General

• ActX does not claim ownership of your content and will not sell your content to any third party.

• We may format your content for display throughout ActX, but we will not modify the essential aspects of your content without your permission.

Service Modifications and Availability

Modification of Services:

• ActX reserves the right to modify, suspend, or discontinue, temporarily or permanently, the services or any part thereof, at our sole discretion, with or without notice to you.

• While we aim to provide reasonable notice when making significant changes to our services, circumstances may require immediate changes without prior announcement.

Service Availability:

• We do not guarantee that the services will always be available or uninterrupted. The services may be inaccessible during periods of maintenance, upgrades, emergency repairs, or due to failure of telecommunications links and equipment that are beyond our control.

• ActX is not liable if the app is unavailable at any time or for any period, whether due to external factors or decisions made by ActX in regard to the operation and maintenance of the service.

Geographical Location

• Our services offer features that make use of geographical location data to enhance user experience and service functionality. For features such as connecting with nearby users, geographical location is essential.

• To utilise these location-based features, you must consent to and enable location services on your device via the device settings. When you enable location services, you allow us to collect and use your location data to provide and improve these features.

• Please be aware that if you choose not to allow access to your location data, you will still be able to use the app, but you will not have access to certain features that require location information. This limitation may affect the overall functionality and experience of the app.

• By using our services, you agree to the collection and use of your location information as outlined above and acknowledge that denying such permissions may limit the service's functionality.

Arbitration and Dispute Resolution

In the event of any dispute, claim, question, or disagreement arising from or related to this Agreement or the breach thereof, the parties hereto shall use their best efforts to settle the dispute, claim, question, or disagreement. To this effect, they shall consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. If they do not reach such solution within a period of 60 days, then, upon notice by either party to the other, all disputes, claims, questions, or disagreements shall be finally settled by arbitration administered by the Arbitration Association chosen by ActX in accordance with the provisions of its commercial arbitration rules.

Termination

User-Initiated Termination:

• You can terminate your account at any time by sending a mail to the app’s support mail. Upon termination, you will no longer have access to any parts of our service that require an account.

ActX-Initiated Termination:

• We may terminate or suspend your access to the app without prior notice or liability, for any reason including, but not limited to, a breach of these Terms.

• While ActX may terminate access at any time without prior notice, we strive to provide a reasonable explanation post-termination, especially in cases of suspected breach of terms.

Upon termination of your account, your right to use our services will immediately cease. All data associated with your account will be deleted within 90 days of closure, except as retained in accordance with our data retention policy necessary for our legitimate business purposes, legal or regulatory compliance.

Disclaimers and Limitations of Liability
